• Eligibility
By using our services, you confirm that you are at least 18 years of age and are legally eligible to enter into a binding contract.
• Client Responsibilities
Clients are expected to:
Provide accurate and timely information, content, and necessary approvals.
Ensure compliance with all applicable laws, including but not limited to DLT regulations, data protection laws, and advertising guidelines.
Review and approve campaign elements within agreed timelines to avoid project delays.
• Campaign Performance
While we work to achieve the best possible results, we do not guarantee specific outcomes such as leads, traffic, conversions, or rankings unless explicitly stated in a written agreement.
• Intellectual Property
All creative materials, marketing assets, and digital deliverables developed by us remain the intellectual property of FMS Media until full and final payment is received.
Clients retain ownership of their own brand assets, data, and intellectual property shared with us during the engagement.
• Confidentiality
Both parties agree to maintain confidentiality of all sensitive or proprietary information exchanged during the course of engagement. No such information shall be shared with any third party without prior written consent, except as required by law.
• Limitation of Liability
FMS Media shall not be liable for:
Any indirect, incidental, or consequential damages
Delays or service disruptions caused by third-party platforms
Any loss of business, revenue, or data resulting from the use of our services
• Use of Third-Party Platforms
Our services may include the use of third-party tools such as Google Ads, Meta Ads, SMS gateways, or web hosting services. We are not responsible for changes, downtimes, or restrictions imposed by such platforms.
• Termination of Services
Either party may terminate services with a 15-day written notice. Upon termination, all outstanding dues must be cleared. We reserve the right to suspend or terminate services immediately in the event of a breach of these Terms or applicable laws.
• Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of India. Any disputes arising from these Terms shall fall under the jurisdiction of the courts in Mumbai, Maharashtra.
• Fintech Services
Loan offers are subject to eligibility, verification, and approval by the lending institution. Interest rates, repayment tenure, processing fees, and other charges may vary based on credit profile and lender policies. Submitting your details authorizes FMS Media and its lending partners to contact you via call, SMS, WhatsApp, or email for the purpose of loan processing and related services. By applying, you confirm that the information provided is accurate and consent to share it with third parties for credit checks and processing, in compliance with applicable laws and regulations.

FMS Media reserves the right to amend these Terms at any time without prior notice. The most recent version will be published on our website. Continued use of our services implies acceptance of the revised Terms.
